Terms of Service

By accessing or using the TheDailyScope platform available at thedailyscope.org (the “Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Platform.

These Terms constitute a legally binding agreement between you and TheDailyScope (“we”, “us”, “our”), a platform operating under that trading name. We may update these Terms from time to time. Continued use of the Platform after any changes constitutes your acceptance of the updated Terms.

TheDailyScope is a premium digital platform dedicated to art, culture, and creative practice. The Platform provides:

• Editorial articles, criticism, and cultural commentary.
• A directory of galleries, museums, studios, and artists.
• Event listings and cultural announcements.
• A Creator Studio for artists and writers to publish and share work.
• Membership tiers with access to premium content, resources, and features.

The Platform is provided “as is”. We reserve the right to modify, suspend, or discontinue any part of the Platform at any time with reasonable notice.

You must be at least 16 years old to create an account or use the Platform. By registering, you confirm that you meet this age requirement and have the legal capacity to enter into a binding agreement under the laws of your jurisdiction. If you are using the Platform on behalf of an organisation, you confirm that you have authority to bind that organisation to these Terms.

To access most features you must create an account by providing accurate information including your name, email address, and country. You are responsible for:

• Keeping your password confidential and not sharing your account credentials.
• All activity that occurs under your account.
• Notifying us immediately at contact@dailyscope.info if you suspect unauthorised access.

We reserve the right to terminate or suspend accounts that we reasonably believe have been compromised or are being misused.

The Platform offers free access to certain content and paid membership tiers (“Enthusiast” and “Creator”) that unlock additional features.

5a. Billing

Membership fees are charged on a recurring basis (monthly or annual) as selected at checkout. Payments are processed by our third-party payment processor Paystack. By providing payment details, you authorise us to charge the applicable fee on each renewal date.

5b. Cancellation

You may cancel your membership at any time from your account settings. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until that date.

5c. Refunds

All membership fees are non-refundable except where required by applicable law. If you believe you have been charged in error, contact us at contact@dailyscope.info within 14 days of the charge and we will review the matter.

5d. Price changes

We may change membership pricing with at least 30 days’ advance notice. Price changes will take effect at your next renewal date. If you do not wish to continue at the new price, you may cancel before the renewal date.

Creator members may submit articles, artwork, event listings, and other content (“Creator Content”) for publication on the Platform.

• Licence to TheDailyScope — by submitting Creator Content, you grant TheDailyScope a non-exclusive, worldwide, royalty-free licence to display, reproduce, and distribute the content on the Platform and in associated promotional materials. This licence ends when you remove your content or delete your account, subject to reasonable technical propagation delays.
• You retain ownership — you keep all copyright and other intellectual property rights in your Creator Content.
• Originality — you confirm that you own or have the necessary rights to all content you submit and that it does not infringe any third-party intellectual property rights.
• Moderation — we reserve the right to review, reject, or remove any Creator Content that violates these Terms or our content guidelines.

You agree not to use the Platform to:

• Post content that is unlawful, defamatory, harassing, obscene, or fraudulent.
• Infringe the intellectual property rights of any third party.
• Impersonate any person or entity or misrepresent your affiliation.
• Send unsolicited communications (spam) to other users or via the Platform.
• Use automated means (bots, scrapers) to access or extract data from the Platform without our written permission.
• Attempt to gain unauthorised access to any part of the Platform or its underlying systems.
• Upload or transmit viruses, malware, or any other harmful code.
• Engage in any activity that interferes with or disrupts the Platform or the experience of other users.

Violation of these prohibitions may result in immediate account suspension or termination, and may be referred to relevant authorities.

All editorial content, design, graphics, logos, and other materials produced by TheDailyScope (excluding Creator Content) are owned by or licensed to TheDailyScope and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from Platform content without our prior written permission.

The Platform may contain links to third-party websites, services, or content. These links are provided for your convenience only. We have no control over third-party sites and are not responsible for their content, privacy practices, or availability. Visiting third-party sites is at your own risk.

You may delete your account at any time from your account settings. Upon deletion, we will remove your personal data in accordance with our Privacy Policy.

We reserve the right to suspend or terminate your account without notice if we reasonably determine that you have violated these Terms, engaged in fraudulent activity, or pose a risk to the Platform or other users. Where we terminate your account other than for your breach, we will provide a pro-rata refund of any prepaid membership fees for the unused period.

The Platform is provided on an “as is” and “as available” basis without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

To the fullest extent permitted by applicable Nigerian law, TheDailyScope and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the Platform, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or your use of the Platform shall not exceed the amount you paid to us in the 12 months preceding the event giving rise to the claim.

You agree to indemnify and hold harmless TheDailyScope and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Platform, your violation of these Terms, or your infringement of any third-party rights.

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or the Platform shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the exclusive jurisdiction of the courts of Lagos State, Nigeria.

We may revise these Terms at any time. For material changes, we will provide at least 30 days’ notice by posting the updated Terms on the Platform and, where appropriate, notifying you by email. The effective date at the top of this page will be updated. Your continued use of the Platform after the effective date of any changes constitutes your acceptance of those changes. If you do not agree, you must stop using the Platform and may cancel your membership.
